Terms of Use.
4 July 2026
These terms apply when you download or use the Soleil iOS app ("Soleil", "we", "us"). By using Soleil you agree to them, together with Apple’s Standard EULA. They are written in plain English on purpose.
In short
- Soleil is licensed to you for personal use on your Apple devices.
- Free and paid features, prices and availability are shown in the App before purchase.
- Apple takes payment, handles refunds and manages your subscription.
- Soleil is wellness guidance, not medical advice - sun decisions remain yours.
- These terms are governed by the laws of England & Wales.
1. About these terms
These terms apply when you download or use the Soleil iOS and watchOS app ("Soleil", the "App"). The App is published by an independent UK-based developer ("we", "us"). By using Soleil, you agree to these terms together with Apple’s Licensed Application End User Licence Agreement (the "Apple EULA"). They are written in plain English on purpose.
2. The licence
Soleil is licensed (not sold) to you for personal, non-commercial use on any Apple device you own or control, on the terms of the Apple EULA. Where these terms add to the Apple EULA - for example on our intellectual property, refunds, or the law that governs disputes between us - these terms apply alongside it.
Read the Apple Standard EULA3. Not medical advice
Soleil provides general wellness guidance about sun exposure based on published UV science, weather data and the information you enter. It is not a medical device, does not diagnose, treat or prevent any condition, and cannot account for every individual factor. Estimates such as UV readings, protection checks and time in daylight are approximations. Always use your own judgement, and follow the advice of a qualified clinician - especially if you have sensitive skin, a history of skin cancer, photosensitivity, or take medication that affects sun tolerance. You remain responsible for your own and your family’s sun decisions.
4. Free and Pro
Soleil may offer free and paid features. The current limits and features are shown in the App and App Store listing. Paid features may include guided sessions, the Real Sun daylight story and extended history. Features can vary by device, operating-system version and territory; some features require an Apple Watch and/or permissions such as location or HealthKit access.
5. Subscriptions and one-time purchase
Pro may be offered as an auto-renewing subscription and/or a one-time purchase. The price, billing period, included features and any trial are displayed by Apple before you confirm a purchase and may vary by country or currency. Subscriptions renew automatically unless cancelled through your Apple account at least 24 hours before the end of the current period. Apple charges your account and manages cancellation. A one-time purchase does not recur and applies to the version and features described at the time of purchase; it is not a promise that the App or every online service will remain available forever.
6. Refunds
All purchases of Soleil are processed by Apple under the Apple Media Services Terms. Apple, not us, handles refunds. You can request a refund via reportaproblem.apple.com or your Apple ID purchase history. We have no power to issue refunds directly and we do not store your payment details.
Request an Apple refund7. Price changes
Prices may change. Apple will provide any notice or consent process required for subscription price changes. A new price does not affect a completed one-time purchase. You may cancel a subscription before a change takes effect, subject to Apple’s applicable terms.
Apple Media Services Terms8. Your data is yours
Your skin profile, sun sessions, sunscreen log, family profiles and history belong to you and are stored on your device. We claim no licence over them and we never access them. You are responsible for the accuracy of the information you enter - the App’s guidance is only as good as the skin type, SPF and clothing details you give it.
9. Third-party services
The App relies on Apple services including WeatherKit (UV and weather data), HealthKit (Time in Daylight, with your permission), StoreKit and notifications. Availability and accuracy of those services depend on Apple, your device, your settings and your network connection. Weather and UV data are estimates provided by third parties and may occasionally be unavailable or inaccurate; the App’s guidance should be treated accordingly.
10. Acceptable use
Please don’t (a) reverse engineer, decompile or modify Soleil except where the law or Apple EULA expressly permits it; (b) bypass purchase or entitlement checks; or (c) interfere with the App or another person’s use of it. Where technically and legally possible, we may restrict access to affected features for a serious breach.
11. Our intellectual property
The Soleil name, design, icons, source code and brand are owned by us or used under licence. The licence in section 2 does not transfer those rights to you. You may mention the App or link to getsoleilapp.com in reviews, articles or social posts, but must not imply our endorsement or sponsorship without permission.
12. Apple’s role (Apple-Enabled Software)
Soleil is distributed through Apple’s App Store, which adds the following terms required by Apple:
- These terms are entered into between you and us, not Apple. Apple is not a party to them and has no responsibility for the App or its content.
- We (not Apple) are solely responsible for the App, its content and any maintenance or support. Apple has no obligation to provide any maintenance or support in relation to the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever in relation to the App.
- We (not Apple) are responsible for addressing any claims relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection or privacy law.
- We (not Apple) are responsible for the investigation, defence, settlement and discharge of any third-party intellectual-property infringement claims relating to the App.
- You represent and warrant that (a) you are not located in a country subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country, and (b) you are not listed on any US Government list of prohibited or restricted parties.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
13. Disclaimers
Soleil is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, conditions and representations not expressly stated here, including any warranty that the App will be uninterrupted or error-free, or that UV, weather or daylight estimates will be accurate. Nothing in these terms removes or limits any non-excludable rights you have under the UK Consumer Rights Act 2015 or similar consumer-protection laws.
14. Limitation of liability
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for business losses suffered by a consumer, for sunburn or health outcomes resulting from reliance on estimates contrary to section 3, or for failures caused by Apple, a network provider or a third-party service outside our reasonable control. Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.
15. Termination
These terms apply while you use the App. You can stop using it at any time by deleting it and managing any subscription through Apple. We may stop providing or updating the App, but this does not remove rights you already have under consumer law.
16. Changes
We may update these terms for legal, security or product reasons. We will update the date above and give reasonable notice of material changes where practicable. Changes will not retrospectively remove rights relating to a purchase already made. If you do not accept a material change, you may stop using the App and cancel any subscription through Apple.
17. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere, you also retain any mandatory protections provided by the law of your home country. You may bring proceedings in the courts available to you under applicable consumer law.
